WHY WAS YOUR DIMINISHED VALUE CLAIM DENIED?

Each insurance company operates in its own manner when it comes to automobile diminished value claims. One constant, however, is that all of them strive to either delay, low ball or outright reject this type of claim in the hope that you, the vehicle owner, will become frustrated and simply give up. Why was your diminished value claim denied? First of all, it would be cavalier to imply that a diminished value report provided by The St. Lucie Appraisal Company will automatically be accepted and a settlement paid to the penny. That is simply not the case but when it comes to defending diminished value claims, insurance adjusters evaluate appraisals prepared by different independent appraisers and act upon them accordingly. If an insurance company determines that they have a good chance of prevailing in small claims or civil court, your claim could likely be denied. Conversely, when confronted with a comprehensive report that provides irrefutable proof of the existence and amount of value that your vehicle lost after collision repairs, they are forced to acknowledge the possibility of losing. We have seen most of the diminished value reports that are prepared by independent appraisers. Methodologies vary but some, of course, are better than others.   1. The information contained herein, is based upon the information provided to me as well as the visual characteristics of the vehicle and its parts at the time of inspection. The opinions expressed herein are based upon; technical training, experience and acquired knowledge in this field of expertise.
  2. Provides sales prices of comparable vehicles and then an arbitrary diminished value amount based on nothing whatsoever that is contained in their report. The appraiser concludes: “In arriving at this figure, I gave consideration to the concerns which a buyer, if knowledgeable that there was a potentially severe accident, would have, and the impact upon whether such buyer would buy the vehicle and the conditions upon which a buyer may buy the subject vehicle.”
  3. Uses a formula similar to the discredited Rule 17-C. Corrective procedures “based on experience” reveal not only the flawed methodology but also a lack of real-world evidence to corroborate their findings.
  4. “Based on my personal experience as a licensed Motor Vehicle Damage appraiser with 21 years of experience in the automotive field, ASE certified mechanic, Associates degree in Mechanical Technology, a licensed automotive inspection and emissions mechanic, review of the estimate, picture review and the type of repairs needed on the vehicle, I place the diminished value at $XXX.XX.”
  5. Simply assigns a diminished value amount with no substantiating information.
  6. “Although subject vehicle was repaired to industry standards, at this time, I find the above to show cause of a combined 15% loss to its dated fair market value.” Their report shows no methodology for determining this amount other than the appraiser’s personal opinion.
  7. “In order to determine this vehicle’s ultimate Diminished Value, we have devised a Point System based on the following categories. They are in order of importance, with the first category representing the aspect of the repair process which has the most impact on the vehicle’s value.” This report uses a formula to calculate the amount of diminished value.
  8. “With over 20 years experience appraising automobiles, it is our opinion that, as a result of this accident, the specific type of vehicle, its age and its miles, would result in the vehicle’s market value having diminished no less than $XXX.XX after satisfactory repairs. This reflects nothing more than the appraiser’s opinion.
  9. “It is the opinion of this expert that there is evidence to suggest the value of the subject vehicle should be diminished value as a result of the body repairs.
  10. Uses a formula based on Rule 17-C modifiers that do not reflect an actual loss of value based on any tangible evidence.

Submitting an automobile diminished value report that simply states an appraiser’s opinion based on their alleged expertise or on a random formula or algorithm guarantees a certain amount of push back from the insurance company. If a magistrate or mediator can’t understand the methodology or doubts the validity of an opinion-based appraisal, you have wasted your money on the report. We learned from these examples from sales managers at Mazda dealerships in Virginia – A minor accident or something showing $1600 worth of damage may or may not take a 10% hit on trade.  Also, that you may lose 10% at least off the book value due to the fact that the car is so new and also being that the accident is minor in nature and normally the loss would be based on what is on the report and if you had it repaired at reputable shop maybe 10% less.

Auto Diminished Value Claims

Disputes over the values of automobiles and trucks involved in total loss claims are common. There are three points of view to consider – the car owner’s opinion, the insurance company’s opinion and the findings of an umpire who is hired when an impasse occurs. Resolution of total loss disputes by invoking what is known as The Appraisal Clause is becoming more common as insurers tighten purse strings. What is the appraisal clause? It is simply an insurance provision allowing either the insurer or the vehicle owner to demand a binding appraisal of damaged property in the event of a dispute as to its value. An independent appraiser is hired by both sides. If they can’t agree, The Appraisal Clause can be invoked by either party. One would hope that this process produces equitable settlement amounts but it doesn’t always work that way. Both retail and fair market value can be subjective. Insurance companies place certain roadblocks such as only recognizing comparable vehicles from tight geographic areas. Insurers disallow recognized sources of book values such as NADA, preferring to use the CCC valuation method which was developed for the insurance industry. Often misrepresentations of prior damage and conditioning or inadequate allowances for mileage differences occur. Even more complicated and arbitrary are Appraisal Clause proceedings involving diminished value.

If the car owner and the insurance company disagree on the value of the vehicle, either may make a written demand to invoke The Appraisal Clause. Each party will select a competent and impartial appraiser. It is preferable that both are licensed appraisers in at least one state. The two appraisers, if in disagreement over the value, will select an umpire. If the appraisers do not agree on an umpire, the matter goes to a judge of the court having jurisdiction.

In the event that The Appraisal Clause is invoked and an umpire is necessary, each party will pay its chosen appraiser and bear the expenses of the umpire equally. This means of alternative dispute resolution is designed to effectively and cost efficiently resolve disputes by avoiding the typical legal process. Arbitration, also known as mediation, acknowledges the existence of a dispute. Each party has the right to specify the credentials of the umpire. The naming of a third-party to serve as an umpire is not a selection until the other has agreed to accept him. He must be both competent and disinterested. Independent appraisers being considered as umpires that receive most of their work from insurance companies have often been considered “advocates” rather than disinterested parties and subsequently disqualified. The same would apply to independent appraisers who derive most of their work from, for example, a large automobile leasing company or network of dealerships.

In order to trigger The Appraisal Clause, both parties must be unable to agree on the value of the property or amount of the loss.The umpire should be free of undue influences and not have prior relationships with any party involved. This strengthens the expectation of good faith in the selection process. The umpire’s authority is usually limited to determining the value of the property. Issues such as coverage, liability, causation and exclusions should be determined before The Appraisal Clause in invoked. Appraisal awards are most often made by umpires who are not experts in law or the judicial process but their rulings are typically enforceable. Umpires are not free to disregard pertinent evidence lest their awards be set aside by magistrates. Both the claimant and the insurance company are bound by the obligation to exercise good faith and fair dealing in the context of The Appraisal Clause. It is not permissible for either the claimant or insurance company to engage in any tactics designed to defeat the appraisal process from its objectives. Neither party may engage in conduct designed to unreasonably postpone, delay or prevent The Appraisal Clause and the subsequent settlement.

New cars at dealerships can get damaged in various ways that aren’t the fault of the dealer. These include customer mishaps in the lot, damages caused by car carriers and, of course, the inevitable accidents that customers get into with their loaners. After repairs are completed, the automobile or truck goes back into the new car inventory. But these vehicles are different in that they have been devalued by the repair history, sometimes by tens of thousands of dollars. New car buyers that would even consider buying them will be looking for deep discounts. Can the dealerships recoup this loss in their bottom line? Diminished Value Methodology

St. Lucie Automobile and Diminished Value Appraiser

How is diminished Value calculated? The St. Lucie Appraisal Company’s service AUTODIMINISHEDVALUE.COM is just one of many independent appraisers that provide automobile diminished value reports for consumers. Each company has its own method of calculating the amount of value a car has lost after undergoing collision repairs. This article will examine each method and furnish explanations on each of them. It is our opinion, of course, that our methodology for calculation a vehicle’s diminished value after accident repairs is far superior to others being used. After reading the information that we have provided, you can make an informed decision about how to proceed with your automobile diminished value claim. How is diminished value calculated?

OUR METHODOLOGY

Our automobile diminished value reports are ultimately designed to be read and decided upon by a magistrate or mediator. In the past, our reports have proved conclusive in winning cases for our customers because they were based on real-world data.

There are six commonly-used methods by which diminished value is calculated.

1) A letter from a dealership declaring that the vehicle has lost value as a result of undergoing collision repairs. A typical insurance company response: “A dealership is not a disinterested third party and has a financial interest in the acquisition price of a trade in vehicle. Their business model is to buy low and sell high. An offer of trade is simply the starting point of a negotiation and does not, in and of itself, establish any specific loss in value. It is our position that the documentation presented by you does not provide any underlying market data in support of the post-accident value of your vehicle.” This approach generally costs you nothing. em>

2) Figures made up out of thin air, usually buttressed by an appraiser’s assertion that they are based on his or her years of experience in the field either buying, selling or rebuilding cars. The cost for this type of report should be negligible.

3) By using formulas or algorithms such as Rule 17-C which assigns modifiers (points) to things such as whether frame/unibody damage or air bag deployment occurred or whether adjacent panels needed to be painted. These types of reports are subjective, simplistic and abstract. In our experience, judges who have attempted to decipher this type of appraisal understood them even less after having them explained by insurance company attorneys than when they first read them. There is a wide range of fees being charged by independent appraisers, from around $250.00 to more than $800.00. The upper end of the scale usually includes the appraiser’s physical inspection of the vehicle. In cases of inherent diminished value, where a car is worth less simply because it now has a bad Carfax, an inspection of the repaired car serves no purpose.

4) The use of automobile auction results. The data will show a number of similar vehicles that were sold at auction, some that were never damaged and others with bad Carfaxes. You can see that the bad Carfax vehicles sold for less but the auction printouts don’t show the mileage, options, colors, etc. of each vehicle nor do they list the extent of the damages that were repaired. Plus, this is not the market you are in.

5) Improper use of Carfax.com retail ads. An appraisal showing random screen shots of similar cars for sale, some of which were previously repaired, to make comparisons. Typically, very little information about the cars such as mileage, condition, how much was paid for the car and, most importantly, a description of the repairs that were done is provided. This method also invites “cherry-picking” of higher and lower-priced cars. Most importantly, asking prices aren’t a true measuring stick because nothing prevents dealers for asking unreasonably high prices for previously repaired vehicles.

6) A diminished value report that is prepared by The St. Lucie Appraisal Company takes into consideration all of the specifics of your car as well as the exact amount and nature of the damages that were repaired. It is as comprehensive a diminished value report as you can find. Our report contains our own data-based opinion. Then we confirm our findings by querying six sales managers at recognized dealerships in your area. Each dealership, their contact information and the name of the manager is all contained within our appraisal. The last paragraph of our report addresses insurance company concerns regarding the use of dealer quotes. It reads: “All of the dealers queried were informed that the subject vehicle was not available for purchase or trade, therefore none of the dealers queried had any vested interest in the subject vehicle.” This method represents unbiased, irrefutable proof of the occurrence and amount of diminished value. Unless there is a problem, we rarely hear back from our customers – a sign that they are receiving fair settlements from insurers.

It is difficult to know which independent appraisers can be relied upon as expert witnesses or simply for advice as the claim progresses.
