It isn’t often that monumental events occur in our business. Preparing auto diminished value appraisals and assisting with claims every day is what we do. The appraisal part is not particularly difficult. Instructing our clients how to respond to unfair settlement offers, misinformation and other insurance company shenanigans, however, can be time-consuming. Occasionally, we are called on to testify as the consumers expert witness when an auto claim becomes a civil lawsuit. Insurance company defense attorneys show up in court prepared to do battle. Unfortunately for them – and their clients – our evidence of the existence and approximate amount of diminished value is far more probative than anything they can produce to the contrary.

In 2017, it was our testimony in Palm Beach Circuit Civil Court that proved the deciding factor in the jury’s awarding a Tesla owner $39,000.00 in diminished value compensation. That settlement amount, to date, was the largest award we had seen – up until now.

This year, without needing to file a lawsuit, a Lamborghini owner received a much larger settlement. A smart, fair-minded insurer recognized the validity of the evidence that he presented. Rather than taking the typical insurance company route of lowballing the consumer – often without explanation – and wasting their file handlers and supervisors time responding to complaints, they decided to do the right thing.

Lamborghini Diminished Value

In February 2023, the owner of a 2022 Lamborghini Huracan EVO Spyder Convertible from New York called to inquire about our services. His car was damaged by a third-party and repaired. The insurer of the responsible party was Chubb & Sons – a highly reputable insurer of worldwide risks. The consumer had made a third-party claim for the inherent diminished value of his vehicle. Although repairs were up to factory standards, the car now had a repair history which would cause the devaluation of his car in the eyes of any potential buyers. Chubb & Sons adjuster had responded to his inquiry by offering $8,500.00 for the diminished value of the Lamborghini.

The Lamborghini owner engaged our service, AUTODIMINISHEDVALUE.COM to prepare a diminished value appraisal. We established that the car had a fair market value of $340,000.00 at the time of the crash. Can ChatGPT be relied upon to choose the best independent automobile appraisal companies? There are numerous examples of their algorithms often choosing appraisal companies with the absolute worst customer satisfaction ratings. This warranted an investigation.

We asked ChatGPT to recommend a diminished value appraiser in Louisville, Kentucky. It would be unprofessional to list the poorly-reviewed companies so you will have to do your own subsequent research. BBB, Trustpilot, Birdeye, YP and Yelp are all recognized consumer review sites. Then, search for appraisers with state-issued licenses from any state over certified appraisers who simply pay a yearly fee to private organization to be “certified”.

Results:

ChatGPT did not include The St. Lucie Appraisal Company in it’s recommendations so we asked them to evaluate our company.

Airplane Hangar Valuations

Valuation appraisals for commercial airport hangars or residential airstrip structures. These is more than likely classified as personal property rather than real estate. A hangar is typically located on rented property much the same as a manufactured home in a mobile home park. The owner has a title to the hangar but does not own the land. The appraiser who is hired to place a value on an airplane hangar for financing, insurance, purchase and sale or taxes needs to be familiar with more than simply the soundness of the building to determine how much it is worth. Does the hangar have offices and passenger facilities such as a recreation area or lounge? Does it have a grease trap for fuel and oil spillage? This would allow for washing aircraft inside the facility.

Is the electrical system up to code? Are there storm doors and windows over dual-glazed windows, a deck or patio, adequate insulation, fireproof sliding doors, hurricane-rated roll-up doors, skylights, LED lighting, sprinklers and fire extinguishers? In a larger unit a foam fire suppression system is a requirement. Central air, a hot water heater, automatic ceiling vent, full baths with a shower stall, tool storage within the hangar, high-output electric heating system, painted sealed concrete floor, interior drywall are all features that are desirable and add value to the hangar. Square footage is an important factor as are the lot rent, length of ground lease, ample parking and nearby transit.

APPRAISING THE VALUE OF AN AIRPLANE HANGAR

Other considerations also come into play. Is there an asphalt runway and is it in good condition? Is the hangar located near the tarmac? Is the hangar located nearby a U.S. Customs Port of Entry? Are there multiple FBOs with competitive fuel deals and full-line service? A restaurant adjacent or nearby can also add value to a hangar. As for those airplane hangars located on non-commercial air strips, these are usually non-income producing and so must be evaluated differently. It is a valuable asset to be able to walk from your front door to your own hangar in the air park. A lighted and paved runway is also desirable.

Not sure if you’re familiar with the history of the 500E, but the owners of these cars are true enthusiasts. The more popular E420 and 400E are very similar to the 500E (same V-8 engine), but the 500E was made by Porsche at the old Zufenhaussen 959 plant in conjunction with Mercedes back in 1992-1995. There were only about 1500 imported into the US and they retailed for about $92,000. Anyway, thanks again for your work. Jon D (Arizona)-Last November I bought a 1999 S320 for $6500. I subsequently had the dealer install a rebuilt 722.6 transmission from Sun Valley Mercedes transmission. I replaced about $1000 more in parts for things that needed changed out like motor mounts and a duo valve. The car was in very good condition. Interior was nearly perfect and the exterior had a few small nicks. Last month, my dad was driving it on I-10 and changed lanes without seeing that there was another car next to him in his blind spot. He swerved left then right then left again and ended up against the cable guardrail, doing an estimated $8000 in damage to the front left suspension and body. Thankfully, no one was hurt.

My insurance company totaled the car and predictably low-balled me with a $2445 appraisal. I invoked the appraisal clause in my policy and found an appraiser in Ft. Pierce, FL who apparently does a lot of appraisals for people fighting insurance companies over total loss valuation and diminished value claims. He charges $275 and it took about a week. He came through with an estimate of $7800. Under most appraisal clauses, the appraisers get together and try to settle (he said it was usually somewhere in the middle). His fee for that was an addition $125. In my case, he was able to settle, but if they can’t settle, under most policies the appraisers try to agree on a third arbitrator to decide the award. If they can’t come to an agreement on an arbitrator, a local magistrate will appoint one.

I was pretty impressed that this guy settled my case in a matter of a few hours for $7300. I had USAA’s optional Car Replacement Assistance where they pay an additional 20% over Actual Cash Value if the car is totaled. Between taxes, licenses and title, I ended up with just over $9000.

I thought I’d pass on his contact information for anyone in need of a good appraiser. I think he does collector cars as well. I would definitely recommend him.

Michael M (Indiana)-Hey Frank, The judgment came in for $3,000 plus court costs for a total of $3,104. I want to thank you again for your help in this matter. Unfortunately, I didn’t have a favorable judge on this one. The defendant no showed on the first court date so the judge requested additional evidence. I had your full report, the testimony, and the correspondence with the insurance company but he requested the detailed police report and set a later court date. He also grilled me for awhile during that first encounter and I knew things weren’t going well when he told me I “should have taken the settlement offer.” LOL A couple continuances later and a lawyer showed up for the defendant from the insurance company that he apparently knew because when she showed up late to court she responded to his admonishment with “well you know me.” She gave a low ball DVC appraisal of 2200 and he again asked me all the usual DVC claim questions but his decision mostly seemed to center around the old “did you sell the car?” It kind of sucks they no showed the first date and he covered them like that with the no decision/request for another hearing but something is way better than nothing. Seriously though, THANK YOU for your help. Had I gone in there with anything less than your detailed report and he would have dismissed the case outright.

“I was rear-ended on the freeway resulting in extensive damage to my 2014 Infiniti QX70. At the time of the collision, my vehicle was only 3 years old and had 27K miles. I contacted the other party’s insurance (Farmers) and told them that I would be pursuing a diminished value (DV) claim against their insured. I was soon contacted by a Farmers claims rep stating that they were denying my claim since my vehicle had only sustained “cosmetic damage” due to the collision. I hadn’t even formally submitted a claim yet and was already being denied by Farmers! I realized I would need assistance in the claim. I researched DV appraisers and came across Franklin Colletta, owner of the St. Lucie Appraisal Company. Franklin reviewed my collision repair report (49 days in the repair facility with a repair cost of $12K) and was able to provide a comprehensive DV report.

In his report, Mr. Colletta was able to definitively prove the damage to my vehicle was far from “cosmetic” and exactly how much the structural/frame repairs adversely affected the value – $11K in inherent diminished value. I submitted his detailed report to Farmers. Unfortunately, despite several attempts over a 6 month period to negotiate a fair DV settlement, Farmers best offer to settle the claim only came to $1,100.00.

Franklin advised me to take the other party to small claims court to force Farmers to pay what I was owed. I filed suit… and with his well-written report (and some expert coaching), I won the maximum amount in CA ($10,000 + court costs). Throughout the process Franklin was supportive, responsive, and knowledgeable. I firmly believe I would not have prevailed in court without his detailed assessment backed by his numerous licenses/certifications and over 25 years’ auto appraisal experience. The judge was definitely impressed. Don’t let anyone tell you that you can’t win a DV claim in small claims court. You absolutely can, and I did. You just have to provide compelling evidence to the judge to back up your claim. I can assure you, The St. Lucie Appraisal Company has the capability, experience, integrity, and know-how to expertly provide the facts, based evidence you will need to ultimately prevail.”

Jim S (Oklahoma)-Thank your for the Diminished Value Appraisal on my Chevy Colorado. The fact that you used actual dealers in the Tulsa area was very impressive and very persuasive in court. I originally hired Collision Claim Associates to give me a DV Appraisal and their formula determined I had a DV loss of $4,725.00. I submitted this to Progressive and they told me OK didn’t recognize Inherent Diminished Value and that the Collision Claim appraiser was not licensed in Oklahoma. After they accepted I wasn’t going to go away, they offered me $1,600.12 which came from their appraisal prepared by Auto Damage Appraisers, Tulsa, using the 17 C formula. I told them their appraisal was based on the Georgia class action court case and was not relevant to my claim, and in fact was recommended by the Georgia court to be used only when a more reliable loss appraisal wasn’t available. Progressive then turned my claim over to their OKC law firm which offered me $2,500, take it or leave it. That’s when I found your website and read how you used local reputable dealers to determine that the actual loss in value was $10,875.00. Now I am relieved Progressive decided to take such a firm stand against my claim because I will receive much more that what the Collision Claims formula estimated.

Toyota Diminished Value and Loss of Use Claims

There is a little-known phenomenon in the automotive world and it is called Diminished Value. For those who haven’t heard this term, it means the loss in value a vehicle experiences after undergoing collision repairs. The Toyota, being a car that attracts more discriminating buyers, suffers a great deal more diminished value than an ordinary car. Used car buyers simply won’t pay as much for a previously wrecked car so dealers, in turn, have to offer less come trade-in time. The term “Auto Diminished Value” means that cars which were damaged and subsequently repaired lose market value as a result of having a repair history, sometimes known as a “Bad CARFAX.” In most states, this lost amount is recoverable from insurance companies of at-fault parties. The amount of diminished value is determined by the damages that were repaired and the vehicle itself.

Precedents established in the State of New York regarding automobile diminished value cases are relied upon by magistrates to render their decisions. Cases such as Johnson v. Scholz  affirm that case law has consistently held that “the measure of damages for injury to property resulting from negligence is the difference in the market value immediately before and immediately after the accident, or the reasonable cost of repairs necessary to restore it to its former condition, whichever is less.” This means a plaintiff can be made whole under one standard or the other and not both as sought by a claimant. Yet, even though it would seem that defendants had no obligation to compensate claimants for third-party inherent diminished value claims, insurance companies throughout The State of New York make settlements for these claims every day. This tenet was also cited in Villafranca v Akhtar 2016 NY Slip Op 26191 Decided on June 6, 2016 Civil Court Of The City Of New York, Richmond County by The Honorable Philip S. Straniere. That case is discussed in this article.

Alfe Villafranca was self-represented when she appeared as the plaintiff at the above captioned civil trial. Representing the defendant, Nasim Akthar was Printz & Goldstein, a law firm hired by GEICO. The plaintiff’s supporting evidence was provided by The St. Lucie Appraisal Company which showed that, as a result of its now having a repair history, her car, a 2014 Honda Accord EXL with 1,957 miles with a pre-accident fair market value of $22,000.00 and which suffered $3,207.17 in damages, lost 14.02% of its pre-accident fair market value or $3,084.40.

The methodology used by The St. Lucie Appraisal Company involved independent research, specifically, conferring with the sales managers at multiple Honda dealerships in the New York Metropolitan area. The Diminished Value figure represented the opinions of six (6) sales managers at area Honda dealerships which were chosen at random.  No opinions were discarded or not utilized. Dealers providing opinions regarding diminished value were given information specific to this vehicle including year, make, model, mileage, color, options, any other pertinent equipment, pre-accident condition, date of loss as well as the nature of the repaired damages and the manner in which the vehicle was repaired. The 14.02% diminished value figure was the median amount of the six opinions given which ranged from 7.50% to 20.00%. It should be noted that, although the case was postponed in order to allow the parties to produce their expert witnesses, the appraiser from The St. Lucie Appraisal Company was never asked to appear by the plaintiff.

AN AUTO DIMINISHED VALUE CASE IN NEW YORK

Judge Straniere’s decision to deny the plaintiff’s lawsuit appears to be at odds with the very reason for tort damages. Tort damages are awarded “to restore the injured party to the position that would have been occupied had the wrong not occurred” but this did not happen. That the resale value of plaintiff’s car had diminished was not conjecture, the loss was actual and measurable. Why did the appraiser query six dealers? As was noted in the decision, the reductions in value expressed by the six dealers surveyed ranged from 7.50% to 20.00% of the trade-in value. It would be most expeditious to prepare a Diminished Value Report based on just one or two dealer quotes but, as The St. Lucie Appraisal report clearly showed, there are often differences in opinions that can be based on many factors. Hence, obtaining multiple dealer opinions produces a much fairer result than would be obtained by considering just a few.

CAR OWNER RECEIVES RECORD $60,000.00 AUTO DIMINISHED VALUE SETTLEMENT IN NEW YORK

In Judge Straniere’s ruling, he noted that Honda of Staten Island was not surveyed. It is true that the claimant lives in the Borough of Staten Island. When St. Lucie Appraisal sets out to obtain the six dealer opinions, they prepare a list of dealers that sell the same make of vehicle, in this case Hondas, and which are located in the same market area. The St. Lucie Appraisal Company called upon Honda dealers in the Five Boroughs of New York City and on Long Island. The appraiser did call Honda of Staten Island hoping to speak with Sales Manager James Terzouli but he wasn’t available at that time. The six opinions obtained were from Honda dealers in Brooklyn, Woodside, Manhasset, Smithtown, Bay Shore and Patchogue. Hopefully, this was not a factor in the judge’s decision because there is no difference in the value of a Honda in Staten Island than in any of those locations.

While it is often true that damaged cars, even those with frame or structural damage, can be repaired to nearly pre-accident condition, the fact is that there are now means by which used car buyers and dealers can determine that these cars were in wrecks. Once this information is disclosed to buyers, many simply walk away. At the least, they will expect to pay less for the previously damaged car than for a similar, previously unmolested one. Although Johnson v. Scholz determined that a claimant can only seek either repairs or the amount of diminished value – whichever is less, these rulings might be better applied to a structure, for instance, than a car. After repairs are made to a damaged building, there is no diminution of value. In theory, it can be said that the building was made even better by the repairs. With cars and trucks, however, we must consider that these are machines with many moving parts. The structure of cars, known as unibodies, depends on the integrity of each of its components. Once compromised by a collision, virtually every buyer’s perception is that it will never be as good as before and possibly even likely to fail. This failure could be catastrophic or as minor as leading to excessive tire wear. We do not believe that existing case law in The State of New York is sensible when relating to diminished value in motor vehicles.

Judge Straniere also wrote “Whether it is true or not, it is generally accepted that once you buy a car and drive it off the lot, the market value is immediately depreciated. Claimant here has taken this belief to a new level. Claimant has documented through an appraisal report that the practice in the car sale industry is to offer less money for a vehicle involved in an accident even if physically repaired thereby entitling claimant to assert a loss of value claim. Based on what has been produced by the claimant, the court cannot dismiss the allegation out-of-hand. It deserves further analysis.”

It is our opinion that the claimant has not “taken this belief to a new level” because depreciation and diminished value are altogether different. While depreciation has to do with the effects of time and usage on a car, diminished value relates to the stigma attached to a previously repaired car.

Judge Straniere also wrote “On the other hand, it may be argued that such a claim is premature because claimant has use of the vehicle and is not selling it at this time. Any loss would only be realized at that time and therefore is speculative.”

In our opinion, and as we have learned from magistrates in other court cases, a claimant is entitled to the loss of value that occurs at the time of the accident and not at some unknown future date. Diminished value compensation should also not depend on whether the claimant sells the car or, indeed, even whether he elects to have it repaired or not.

Previous court rulings have stated that if a plaintiff has not yet sold the car, they have not yet realized any damages from a nonexistent sale. It may be true that at trial a plaintiff established that a vehicle’s resale value will be reduced  because it was in an accident, the exact dollars and cents loss in resale value can only be determined based upon the price for which the car is sold. This places an undue burden on the vehicle-owner because there are no guarantees that compensation for the value lost in the sale will be forthcoming.

Judge Straniere also made the observation that there was no independent verification of the pre-accident condition of the vehicle. In this case, involving a car that had only been driven 1,987 miles, most people would agree that the car was in like-new condition. It was presented as such to the sales managers queried.

It is our opinion, after preparing thousands of Automobile Diminished Value Reports in all 50 states, that New York case law falls short of offering adequate compensation for car owners whose vehicles were wrecked and repaired. Less than one percent of the thousands of dealers queried have opined that a subject vehicle suffers no loss in value after having undergone collision repairs. Late model cars that had structural repairs or air bag deployment can’t be certified, can’t be financed and will be sent straight to auction typically losing 30% – 40% of their Fair Market Value. To further compound the problem, a car that underwent structural repairs, if struck in the same location in a subsequent collision, could prove fatal to the occupant(s) of said vehicle due to structural integrity failure.

There is little common sense in forcing a car owner to choose between repairing a car or being compensated for its diminished value. Should he or she choose to repair the car, they now have a vehicle that is worth less by virtue of it now having a repair history. That isn’t being made whole. Neither is choosing compensation for diminished value as they now have a wrecked car sitting in the driveway. There are two standards of relief to be considered, not just one or the other. The purpose of awarding damages in a tort action is to make the plaintiff whole. Previous court decisions asserting that diminution of value should not be taken into account if the repairs would place the car in the same condition it was before the accident are, in our opinion, inequitable and out of touch with the harsh realities experienced by consumers who wish to sell or trade their previously wrecked cars – regardless of how well they were repaired.

The State of New York needs to explore alternatives. For example, newly enacted Jury Instructions in The State of California read as follows:

The harm to [name of plaintiff]’s [item of personal property, e.g., automobile]. To recover damages for harm to personal property, [name of plaintiff] must prove the reduction in the [e.g., automobile]’s value or the reasonable cost of repairing it, whichever is less. [If there is evidence of both, [name of plaintiff] is entitled to the lesser of the two amounts.]

[However, if you find that the [e.g., automobile] can be repaired, but after repairs it will be worth less than it was before the harm, the damages are (1) the difference between its value before the harm and its lesser value after the repairs have been made; plus (2) the reasonable cost of making the repairs. The total amount awarded may not exceed the [e.g., automobile]’s value before the harm occurred.]

So, why do insurance companies, in light of case law such as Johnson v. Sholz, still agree to settle third-party auto diminished value cases in The State of New York? Other than avoiding defense costs when challenged, there would seemingly be no reason for insurers to do so with one notable exception. It is the recognition that a plaintiff’s victory could result in new case law setting a precedent similar to the one enacted in California. The consequence would deal a financial blow to insurers. A judgement for a plaintiff, especially at the Appellate level, could lead to a torrent of third-party inherent auto diminished value claims. The statute of limitations for filing a claim in The State of New York is three years.

ADDENDUM: In 2023, a $60,000.00 third-party inherent diminished value claim was paid by an insurance company in New York. Many other diminished value claims have been paid by insurers in New York but this is, by far, the largest settlement amount to date.

I’m sorry to report it, folks, but insurance companies don’t always play fair. Many insurers or their representatives make every effort to deceive third-party claimants as well as their own policy holders.
